TERMS & CONDITIONS OF PARTICIPATION IN THE (‘EVENT”)

of the Broadcast Business Intelligence LLP (last updated 08/2019)

Participation in the Competition and/or Event is subject to and conditional upon the following terms and conditions:

  1. REQUIREMENTS

1.1         Only participants properly registered in accordance with these terms and conditions are eligible to take part in the Competition (“Participants”).

1.2         Participants in Kids Got Talent must be between 5 – 16 years old on the date of Registration and must be registered by a Parent or Legal Guardian on their behalf.

1.3         Parents or Legal Guardians registering on behalf of a Participant shall be deemed to have accepted these terms and conditions on the Participant’s behalf and further agree to take full responsibility for such Participants in competition.

  1. TERMS OF PAYMENT

2.1         Parents or Legal Guardians is required to pay Fee of Rs. 200/- per participant for the Competition after registration is completed

2.2         If payment process cannot be completed for any reason, the applicant cannot participate in the Competition.

2.3         If the registration and payment is accepted for participation in competition, no cancellation is permitted by Participants, and the fee is non-refundable other than as otherwise stated in these terms and conditions.

  1. COPY RIGHT

3.1         Video and any other work documentation by participant is protected by copyright. No commercial sound or image recording (in particular photographs, films, videos) is permitted.

3.2         Participants consent to our duplicating recordings, uploading them online and making them publicly accessible, as long as this usage does not unreasonably prejudice the Participant’s interests; our interests are to be reasonably taken into account.

  1. DATA PROTECTION

4.1         We will collect, process and utilise the Participant’s necessary data for the purpose of fulfilling the competition and/or event.

4.2         We are entitled to supply data to other participants and sponsors for the competition and/or event, but only for use for the purposes of the event, e.g. for sending out video for use in preparing for the competition and/or event.

4.3         Any other processing or usage of data will only take place with the Participant’s consent. The Participant may ask us for information about the content, scope, date and form of the consent at any time.

  1. COMPETITION AND/OR EVENT CANCELLATION / CHANGES

5.1         We reserve the right to refuse/cancel registrations for competition. If BITV refuses a registration, registrants will be offered a refund.

5.2         We are entitled to cancel the competition and/or event due to low enrolment, or other circumstances which would make the competition / prize distribution event non-viable.

2.3         If we cancel the competition and/or event, registrants will be offered a full refund. Should circumstances arise that result in the postponement of an event, registrants will have the option to either receive a full refund or transfer registration to the same event at the new, future date.

Above policies apply to all BITV competitions and/or events unless otherwise noted in the corresponding event materials. Please read all individual competition and/or event information thoroughly.

  1. LIABILITY AND INSURANCE

6.1         Participation in the Competition and/or Event is at the Participant’s own risk. The Participant irrevocably agrees to hold harmless, indemnify and reimburse the Organiser from and for any liability, sum, costs, damages or expenses (including legal and professional fees) incurred by the Organiser in connection with any loss or damage arising out of the Participant’s attendance at and participation in the Event or any part thereof (except where any such loss or damage is caused by the negligence of the Organiser or any of its employees).

6.2        Nothing in these terms and conditions shall exclude or limit the liability of the Organiser:

6.3.1        for fraud or fraudulent misrepresentation; or

6.3.2        for any matter which it would be illegal for the Organiser to exclude or attempt to exclude liability.

6.4         The Organiser will not be liable for any actions of any spectators or other third parties.

6.5         The Organiser will endeavour to provide an Event finish time for the Participant however it cannot be held responsible for any computer result anomalies or any technical malfunctions.

6.6        Except as stated in clause 6.2, the aggregate liability of Organiser to a Participant with respect to all claims under or in connection with the Event shall be limited to damages not exceeding the Participation Fee.

  1. COMMERCIAL PROVISIONS

7.1     The Organiser reserves the exclusive right and license throughout the world (and Participant hereby grants the Organiser such exclusive right and licence at no cost) to interview and/or photograph and/or record video of the Participant for the competition and/or Event (and before and after the Event as the Organiser may reasonably require) and to the unlimited, worldwide, sub-licensable right to upload, reproduce and use in all current and future media (including without limitation, print, audio, visual, audio-visual, virtual media, the Internet, mobile telephony and so-called “3/4G” technologies) the Participant’s name, likeness and image or voice, video and film portrayals and other means of identification of the Participant, and any biographical or other information or data related to the Participant (including run times and results), in connection with the production, advertisement, marketing, promotion or sale of Event sponsor products and/or the promotion, marketing or advertisement of the Organiser or any Event sponsor.

7.2     Participation in the Event does not confer any rights (by implication or otherwise) on the Participant to use, alter, copy or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property of the Competition and/or Event.

7.3     No Participant shall engage in any form of “ambush marketing” (ambush marketing is an activity by a party which utilizes the publicity value of an event without having any official involvement or connection with the event) and shall not breach or infringe the rights of any sponsor or other party commercially associated with the Event, nor conduct unauthorized promotions or other commercial activity.

  1. MISCELLANEOUS

8.1     These terms and conditions (and the documents referred to in them) constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the Competition and/or Event. The Participant acknowledges and agrees that in submitting the Online Entry Form (and the documents referred to in it) he/she does not rely on, and shall have no remedy in respect of, any statement, representation, warranty, understanding, promise or assurance (whether negligently or innocently made) of any person) other than as expressly set out herein.

8.2     If any provision of these terms and conditions is declared by any judicial or other competent authority to be void voidable illegal or otherwise unenforceable the provision shall be amended in such a reasonable manner or it may be severed from the terms and in either competition and/or event, the remaining provisions shall remain in full force and effect.
